The Australian Therapeutic Goods Administration (TGA) has recognized the insurmountable evidence that points to failing metal-on-metal implants releasing chromium and cobalt in patients. In many cases, the human body is not capable of removing these metals from the body quickly, leaving patients with high levels of metal ion concentrations in the tissue around the faulty medical device. As we have mentioned before, chromium and cobalt in patients’ blood have lead to the implants failing early as well as tissue inflammation around the implant.
The TGA has advised patients with these medical devices to have regular checkups of the implants to monitor the metal levels in the body. The FDA has also shown concern, but their weak mandate was only for figuring out how to study this, not on what should be done. Of course, clients and their lawyers are steps ahead of the FDA, and we expect juries around the country will deliver stinging verdicts against DePuy.
