When we place a family member in a nursing home, we do so with the belief that he or she will be well cared for. And if something should happen to them due to negligence on behalf of the facility, then it is important that there be some mearsure of accountability.
The family of a woman who was fatally injured in a fall recovered $1,102,000 in a wrongful death lawsuit (among other claims) against a nursing home. The victim was a woman who suffered from dementia, Alzheimer’s disease, hypertension, diabetes, hypertension, left-side hemiparesis, and deep vein thrombosis. She also suffered from a cerebrovascular accident and she had a pacemaker. Due to her frail state, she was not permitted to move about the nursing home without an attendant.
The victim, a Staten Island resident, attempted to get out of bed. The attending certified nursing assistant observed this and moved her to a wheelchair. He then moved her to the nursing station, to keep an eye on her.
While he was filling out paperwork, the resident attempted to stand up and she fell. The fall resulted in a broken hip, which, due to complications, ultimately led to her death. The nursing home relies on certified nursing assistants to keep an eye on all residents..
