Misused surgical tools

By Rheingold Giuffra Ruffo Plotkin & Hellman LLP

Surgical tools are the unsung heroes of the operating room. Without surgical tools, doctors could not perform life-saving procedures. Surgical tools are also sensitive and dependent on exact maintenance procedures. Improper handling, repair, cleaning or even use during surgery could damage them and reduce their effectiveness during your surgery.

For example, during an endoscopy exam, doctors tend to use the lens as leverage, which can bend or warp the lens. You probably watched more than a few hospital-themed television shows that showed doctors tossing used instruments into a water basin. Unfortunately, that happens in real life, too. Those tools, while they all appear crafted out of steel, are delicate and such rough handling can disturb or break them.

Manufacturers and medical associations describe in detail proper handling and maintenance procedures to ensure the tools remain in tip-top operating shape. But, many hospitals do not follow the policies in place to guide staff in these procedures. The result is that many tools are damaged, and surgeons must use sub-par equipment during surgeries.

If you were harmed during a surgical procedure, you may want to speak to a lawyer. As you can see, even the maintenance of surgical tools requires a well-coordinated team and hospital policy. If even one aspect of that process is interrupted, it could undermine the efficacy of your surgery. A lawyer can help you by going over the hospital policies and records to determine if any negligent or other tortious conduct resulted in your injury. You shouldn’t have to pay for your injuries; you deserve compensation to help you move on with your family.
