A compensation program has been set up by the Archdiocese of Brooklyn to pay compensation for children who were abused in the past by priests and other clergy members. This complements the similar plan in operation for New York for some time. The church administrations are using an outside settlement company to evaluate and pay claims for minors who have been sexually abused.
Before these plans went into effect, children who had been abused years ago had no recourse to suit under New York law, as the courts had held that they were time-barred. These plans, however, have the effect of reviving the claims–though there are time limits for the presentation of claims under these plans, and the New York one will end soon.
There are no set amounts under the plan, and there is also no limit on what the outside administrator can direct to be paid, either per case or overall. The administrator considers matters such as the type of sexual conduct, what the child suffered, how long the abuse continued, and the proof pertaining to such events.
