Paragard Bellwether Trial Update

The Paragard Multidistrict Litigation is moving forward after US District Court Judge issued the latest scheduling order concerning deadlines for discovery, including disclosure of experts and the filing of motions. The latest order takes the multidistrict litigation to the end of February 2024 with the first bellwether trial yet to be determined but in all likelihood at the beginning of 2025.

The Paragard MDL has been consolidated in US District Court for the Northern District of Georgia. As of this writing, there were 2,444 pending lawsuits and a total of 2,521 cases filed against the company in the federal court in Georgia under MDL number 2974.

The Paragard lawsuits allege that a design flaw in the IUD has led to a significant risk of the IUD breaking upon removal. The lawsuits claim that patients were never warned about the design flaws or the significant risks they would face in having the Paragard IUD implanted. As a result many women have had to undergo surgery to have the broken medical device removed. Serious side effects of Paragard include ectopic pregnancy, endometriosis and perforation. You should not use Paragard if you are allergic to copper, polyethylene or barium sulfate. Although rare, some women have developed dermatitis and eczema-type symptoms, which resolved after removing the copper-containing IUDs.
