A cyclist was knocked off of his bike after a collision near the intersection of Beech Street and Richard Street in the village of Atlantic Beach. The plaintiff, a 52-year-old man, was cycling against the flow of traffic and was knocked to the ground when a van failed to yield while executing a right turn onto the street.
The plaintiff, Jack Glasser, sued both the driver of the van who he accused of being negligent in operating his vehicle and the van owners for being vicariously liable. Glasser was brought to Long Beach Medical Center where he was treated for minor injuries.
Glasser claimed to have sustained herniations of his spinal discs and two fractures of his left leg’s fibula as a result of the accident. The injuries required him to undergo conservative treatment including acupuncture, physical therapy, pain management and surgery for a discectomy and fusion of levels of his spine. The plaintiff also claims to suffer from permanent residual pain and physical limitations.
Both parties negotiated and reached a pre-trial settlement of $ 1,300,000 awarded to the plaintiff.
